Occupational safety and health
All employers and employees have a duty of care to ensure a safe and healthy workplace.
In Western Australia, the Occupational Safety and Health Act 1984 (the Act) applies to most workplaces - other than those where work is carried out on a mine, petroleum well or petroleum pipeline (covered by the Mines Safety and Inspection Act 1994) or those under the control of the Commonwealth Government. The Act sets out the legal responsibilities for safety and health at work.
All employers have a 'duty of care' to protect the safety and health of:
- all employees;
- other persons in the workplace who are not directly employed (such as members of the public); and
- contractors in relation to matters over which the employer has control.
Commerce's WorkSafe division is responsible for administering the requirements of the Act and its Regulations. WorkSafe also provides information to industry and the community to promote the prevention of work related injury and harm to health.
