Parental leave

Parental leave is available to most employees on the birth or adoption of a child.

Most employees (including casuals) are entitled to 52 weeks unpaid parental leave following the birth or adoption of a child, if they have:

  1. completed 12 months continuous service with an employer; and
  2. a reasonable expectation of ongoing employment with the employer.

Employees are entitled to return to the position they held in a permanent capacity immediately before starting parental leave. 

There are numerous provisions and requirements relating to parental leave. Commerce has produced a parental leave publication to assist employers and employees understand this entitlement.
