Annual leave
The Minimum Conditions of Employment Act 1993 provides four weeks paid annual leave per year for full time and part time employees
Permanent employees are entitled to paid annual leave for the number of hours they are ordinarily required to work in a four week period - up to 152 hours each year.
An annual leave calculation sheet is available to assist employers and employees calculate annual leave entitlements for full-time and part-time employees.
The Minimum Conditions of Employment Act 1993 (MCE Act) does not provide for annual leave loading. Subsequently, an employer whose business is covered solely by the MCE Act is not obliged to pay annual leave loading to employees. It should be noted that most State awards provide for this loading.
The MCE Act allows employers and employees to agree that up to 50% of an annual leave entitlement will be foregone for an equivalent benefit (usually cash). Such agreements must be in writing and cannot be made a condition of employment.
