Westpoint Realty Pty Ltd (in liq), Lanepoint Enterprises Pty Ltd, Daniel Egan, David Lewis and Thomas Haynes have been charged by the Commissioner for Consumer Protection with offences in respect of alleged breaches of section 12(2)(b) of the Fair Trading Act 1987.

The directors of Westpoint Realty Pty Ltd (in liq), being Norman Carey and Sean Niven, and the company secretary, Graeme Rundle, have been charged by the Commissioner with offences pursuant to s 81(1) of the Fair Trading Act.

The matter was listed for mention before Magistrate Lane in the Perth Magistrates Court on 13 February 2009 on which occasion the prosecution requested the court to stand the matter over for one month to allow the DPP's consent to be obtained in relation to having the charges committed for trial in the District Court. Magistrate Lane ordered that the matters be listed for mention only on 13 March 2009.
