Auctioneers' exemption
Auctioneers may be exempted by the Commissioner from compliance with the Motor Vehicles Dealers Act 1973 provided the selling of vehicles does not constitute a significant part of an auctioneer's business.
The Commissioner adopts the following principles when determining what constitutes "a significant part of an auctioneer's business" for the purposes of Section 31 of the Act:
- if the value of the vehicles sold annually exceeds 10 per cent of the dollar value of goods sold by the auctioneer; or
- if the number of vehicles sold annually is greater than 25.
Under the policy, exempted auctioneers are not permitted to sell vehicles on behalf of trade owners. Trade owners are defined as licensed dealers, finance companies and hire car companies.
Each 'natural person', or partner or director of the entity applying for an exemption must prove that they are of good character and repute and a fit and proper person to hold an exemption.
The exemption may be granted subject to conditions imposed by the Commissioner.
The exemption can be revoked at any time.
